Montgomery County Democratic Party (MCDP) — Content Submission Terms

By submitting or providing any photographs, videos, audio recordings, written stories, testimonials, comments, designs, artwork, or other content (the “Submissions”) to the Montgomery County Democratic Party (MCDP), you hereby grant MCDP, and those authorized by MCDP, a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, display, and create derivative works from the Submissions in any media format—present or future—for any lawful purpose, including but not limited to campaign communications, outreach, fundraising, advertising, education, newsletters, or promotional activities.

You further grant MCDP the right to use your name, likeness, voice, story, comments, and persona in connection with the Submissions. You waive any right to inspect or approve final edits, published uses, or derivative works.

Photographer Credit: MCDP will make reasonable efforts to credit photographers or creators when feasible and appropriate, but cannot guarantee attribution in all uses or formats.

With respect to any photos, videos, or other media captured by or on behalf of MCDP (the “Recordings”), you grant the same rights listed above and acknowledge that MCDP owns all associated rights.

Your Representations & Warranties

You affirm that:

1. You are at least 18 years old—or have the permission of a parent or guardian (if any subject is under 18).

2. You are the sole creator and/or have secured all rights needed to submit the Submissions and grant the permissions stated herein.

3. You have obtained written consent from anyone identifiable in your Submissions, including parents or legal guardians for minors.

4. Your Submissions do not infringe upon any third-party rights, including copyrights, trademarks, privacy, or publicity rights.

5. You will not license or distribute the Submissions for use in any other political campaign, advertisement, or commercially competitive context.

6. You confirm that your Submissions were created on your own time, without the use of any employer-owned equipment or materials, and that no third party has any claim or interest in the content.

Liability Release & Indemnification

You release, discharge, and agree to hold harmless MCDP, its officers, directors, staff, agents, volunteers, and affiliates from any and all claims, demands, or liabilities related to the use of the Submissions—including, but not limited to, claims of infringement, defamation, or violation of privacy or publicity rights.

You agree to indemnify and defend MCDP from any third-party claims arising from your breach of these terms or representations.

Additional Terms

• No compensation is owed to you for any use of the Submissions.

• MCDP is under no obligation to use, publish, or distribute your Submissions.

• All rights granted herein are fully assignable and sublicensable by MCDP.

• These terms are governed by the laws of the State of Ohio, and any disputes shall be resolved exclusively in the courts of Montgomery County, Ohio.
